In the Supreme Court's latest session, 29% of the decisions were determined by 5-4 votes. So it's little wonder that Sonia Sotomayor's nomination — although it's not expected to alter the political balance of the Court — has prompted handwringing from conservatives and liberals alike. Indeed, recent split rulings on racial discrimination and the Voting Rights Act illustrate the dramatic impact a single appointment can have on closely divided landmark decisions like Roe v. Wade. Tonight, University of Chicago professors Geoffrey Stone and Richard Epstein review the 2008-09 term highlights and discuss the Sotomayor nomination and its impact on the Court's future.
