Fashion Law: IP Protection of Designs and Licensing Agreements BasicsFIDM (tbd) (Los Angeles, CA, United States) Map it $20
In this workshop, we will cover intellectual property legal protections as they apply to fashion designs and brands. First, we will discuss copyright and the limited protection it affords designs. Second, we will discuss design patents and their application to the fashion industry and conclude with a review of trademarks and trade dress protections.
In the second half of the presentation, we will discuss fashion industry licensing. Our emphasis will be on how designers can build synergies and followings for their designs, brands, or designing services through collaborative agreements with fashion apparel manufacturers and retailers, strategic marketing ventures, or product line expansion into other categories (cosmetic, fragrance, or lifestyle). Finally, we'll review in helpful detail several "real world" fashion industry licensing agreements, by examining and discussing pertinent clauses, relative negotiation leverage, and anticipated outcomes. Sample contracts and other helpful background materials will be provided as course handouts.
By popular request, we're featuring two of the attorneys from CLA's well-received Fall 2013 "Protecting Fashion Designs" program held at Bloomingdale's Century City:
Nancy L. McCullough, principal of Law Offices of Nancy L. McCullough and a California Lawyers for the Arts Board of Directors member. Former in-house counsel to Yahoo!, Capitol Records, and Sony Music, Ms. McCullough’s current practice focuses on intellectual property, branding, digital technology, entertainment, and media law in transactional, advising, and pre-litigation contexts. She works with prominent and emerging entertainment companies, designers, artists, authors, producers, and technology innovators.
Attorney Christa Perez is a member of the California Fashion Association and partner at Friedman Stroffe & Gerard, P.C., in Orange County, California, where her practice consists of general business and corporate law, as well as intellectual property matters, including trademarks, copyrights, and licensing. Ms. Perez works extensively with clients in the action sports and apparel industries, including several prominent California lifestyle brands.
